Introduction[]

The Foreign Division (TFD) is a relatively traditional yet unique alliance in Cyber Nations. The alliance was founded by Tamurin on the 21st of February 2007, and during the Third Great War accepted refugees from both sides. TFD is a democratic alliance with an elected legislative body (Senate) and several ministers as well as a Speaker of the Senate as head of the government.

Membership in The Foreign Division is open to all members of Cyber Nations. We don’t ask you where you were and what you did. Here with us only what you are and do now and in the future counts. This is your place to start over, leave the past behind and move on. We ask that applicants end any war(s) they may be involved in prior to seeking membership.

All members enjoy the right of free speech, security and identity protection. It is illegal for any government body to investigate the past of any member. This information may only be provided by the members themselves.

Charter[]

The Second Charter of the Foreign Division.

As ratified by the Senate of The Foreign Division on March the 15, 2011:

I. Article One: Membership in The Foreign Division (TFD)[]

I A. To be considered a member of The Foreign Division, a nation must have applied and been masked as a member at The Foreign Division's forums, must wear "The Foreign Division" as their ingame alliance affiliation, and must show their TFD ID number in their nation's bio. “The Foreign Division” is a blue team alliance, however, members are not required to be on the blue team.

I B. Membership in “The Foreign Division” is open to all members of Cyber Nations. We don’t ask you where you were and what you did. Here with us only what you are and do now and in the future counts. This is your place to start over, leave the past behind and move on. We ask that applicants don't join under false pretenses by ending any war(s) and diplomatic situations they may be involved in prior to seeking membership.

I C. All members enjoy the right of free speech, security and identity protection. It is illegal for any government body to investigate the past of any member or applicant, but this information may only be provided by the members themselves or another alliance will be taken into consideration.

I D. All members commit themselves to obey the laws of “The Foreign Division” and inform themselves about laws and rules. Notably, all members are required to act as called upon during times of war.

II. Article Two: Member Rights and Obligations[]

II A. All nations of The Foreign Division, whether they have just joined or have been a member for years, possess the same rights and privileges of members of The Foreign Division who have been a member since the beginning. These rights and privileges include:

II A 1. The right to a vigorous defense from hostile attacks by outside parties.

II A 2. The right to equal access to aid and advice in growing their nations.

II A 3. The right to voice their opinions on any issues that concern the alliance whether they be related to alliance development, foreign relations, or military proceedings.

II A 4. The right to govern their nations as they see fit as long as they do not infringe upon the ability of other members of The Foreign Division to govern their nations or put the safety of The Foreign Division in jeopardy.

II B. In addition to having rights and privileges, members of The Foreign Division also are also subject to certain obligations. Failing to meet these obligations may be grounds for dismissal from the alliance.

II B 1. Members of The Foreign Division are expected to remain respectful to each other at all times. The Foreign Division recognizes that disagreements happen, but members are encouraged to keep things civil at all times and harassment, name calling, and disruptiveness will not be tolerated.

II B 2. Members of The Foreign Division are obligated to assist each other in times of crisis because by working together, they are able to do more than they are alone. In the event that a member of The Foreign Division is under attack, the other members of The Foreign Division are expected to come to their aid.

II B 3. Members of The Foreign Division are expected to be engaged in the business of the alliance. Although The Foreign Division recognizes that not everyone can be vigorously active, members are expected to be active in at least some capacity. At a minimum, members of The Foreign Division shall be expected to read and respond to official communications from the leaders of The Foreign Division relating to issues that affect the entire alliance.

II B 4. Members of The Foreign Division are expected to live up to the commitments that they make to each other. Therefore, members are expected to carry through on their promises to sell technology to or trade with other members.

II B 5. Members of The Foreign Division are expected to respect the secrecy of the alliance at all times. Therefore, members are expected to respect the fact that information from inside the alliance is meant to remain within the alliance and disseminating information to outside parties without authorization shall not be tolerated.

III. Article Three: The Pentarchy[]

The Foreign Division shall be governed by a council consisting of five elected Pentarchs.

III A. The Pentarchy shall consist of three Controlling Pentarchs and two Universal Pentarchs.

III A 1. Each of the Controlling Pentarchs shall be responsible for managing and overseeing a specific area of alliance life:

III A 1 a. Controller of Diplomacy: responsible for coordinating the foreign relations of the alliance by recruiting and dispatching ambassadors, communicating with other alliances, and negotiating treaties

III A 1 b. Controller of Prosperity: responsible for coordinating the internal development of the alliance by administrating programs for member recruiting, member education, trade circles, tech deals, and foreign aid

III A 1 c. Controller of Security: responsible for coordinating the defense, protection, and warmaking programs of the alliance

III A 2. Each of the Controlling Pentarchs shall have the power to direct and control all actions within his/her area of focus and may appoint deputies and other staff to assist in this work.

III A 3. The universal Pentarchs shall not be responsible for any particular area of the alliance but shall have the ability and responsibility to assist in all areas of alliance life to ensure that things are working as well as they can be. Additionally, they will be directly responsible for providing oversight to the Directorates and for giving the other Pentarchs recommendations on whether Directorates should be maintained and what other Directorates should be created.

III B. The Pentarchy shall make decisions on a consensus basis with the following margins:

III B 1. 3 of 5 Pentarchs: forming and dissolving directorates and appointing and dismissing directors, signing and canceling treaties, and making all other decisions that affect the global environment of the alliance and are not confined to the areas covered by the Controlling Pentarchs

III B 2. 4 of 5 Pentarchs: declaring war and declaring peace, amending the charter, and approving mergers, annexations, and disbandment

III C. The Pentarchs shall be popularly elected by the membership of the alliance. Each Controlling Pentarch shall be elected separately and candidates for those positions may run for more than one Controlling Pentarch position and may run for both Controlling and Universal Pentarch positions. If a candidate finishes first in a race for more than one position s/he may choose which position s/he serves in as long as all Controlling Pentarch positions are filled first. Candidates may also choose to run for the Universal Pentarch positions alone.

IV. Article Four: The Magistrates[]

The Magistrates shall be responsible for coordinating the judicial system of the alliance and conducting oversight of the Pentarchy.

IV A. The Judicial Branch shall be coordinated by three popularly elected Magistrates.

IV A. Any member of TFD that has been a member of the alliance for at least three months may run for a position as a Magistrate of TFD. Once elected, a Magistrate serves a two month term.

IV B. The Duties of the Magistrates are as follows:

IV B 1. Give oversight to the Pentarchy and ensure that all provisions of the Charter and other governing documents of The Foreign Division are being followed.

IV B 2. Review the efficacy of the Pentarchy. A report detailing their findings must be posted publicly no later than one week before voting begins in an election.

IV B 3. In concordance with the Pentarchy, resolve any disputes concerning the legal wording of the Charter. This resolution will be considered the way it was meant to be interpreted.

V. Article Five: Directorates[]

If a member of the alliance feels that certain areas of alliance business are not being properly addressed by the existing ministries, s/he can petition the Pentarchy for the creation of a directorate.

V A. The process of creating a Directorate will go as follows:

V A 1. The member of the alliance proposing the directorate submits the mission statement to the Pentarchy.

V A 2. The Pentarchy votes on whether to create the directorate. If 3/5 of the Pentarchy votes in the affirmative, the Directorate will be created.

V A 3. The Pentarchy must re-approve all Directorates each term for them to continue functioning.

V B. The member who proposed the directorate becomes the coordinator and takes on the title of Director. The Director can be removed by the Pentarchy by 3/5 vote if the Pentarchy is not satisfied with his/her performance.

VI. Article Six: Elections[]

VI A. Pentarchy and Magistrate elections shall be held every two months. To be eligible to stand for election, a candidate must have been a member of the alliance for at least 90 days.

VI B. If a Pentarch or a Magistrate becomes unable to do his/her job for any reason, a special election shall be held immediately to fill the seat. The electoral process shall be the same as if it was a regular election and the newly elected official shall serve until the next regular election.

VI C. If the membership of The Foreign Division is dissatisfied with the performance of one of its elected officials, it can conduct a recall election. If the recall election is successful, elections must immediately be held to fill the recalled official’s seat. The new official that is elected will serve until the end of the official s/he replaced's term. The recall process is as such:

VI C 1. A petition is posted in the Government Commons stating the reasons for the recall

VI C 2. 20 members of The Foreign Division must sign the petition for the recall for the process to go forward

VI D 3. The Magistrates commence a recall election poll that will last 7 days.

VI D 4. If 66% of a quantity of members equal to 1/2 or more of those that voted in the last election vote in favor of the recall, the Pentarch or Magistrate will be removed from office.

VII. Article Seven: State of Emergency[]

A state of emergency is a situation where the internal and/or external security of TFD is threatened. A state of emergency may only be invoked in situations similar to: war, serious international tensions close to war, rebellion, collapse of the internal structure of TFD, major unavailability of the TFD government - however, these possible scenarios are only a fraction of scenarios where a state of emergency may be announced. The goal of the state of emergency is to create a fast-acting government that can address and quell the source of the problem.

VII A. The following people can announce a state of emergency, and the following is the chain of command during a state of emergency:

VII A 1. Pentarch

VII A 2. Highest-ranking members of Pentarchs’ staffs

VII A 3. Magistrate

VII B. If nobody is available, but an emergency situation is obviously at hand (e.g. a full-grown frontal attack that is threatening the existence of TFD and its members), the emergency shall automatically be declared and may be formally declared by any of the authorized members later.

VII C. During a state of emergency, an Emergency executive Committee (EEC) shall be created. The Emergency executive Committee (EEC) consists of all members of the government (Pentarchs, Pentarchs’ staffs, and Magistrates).

VII C 1. The Emergency executive Committee (EEC) rules by decree. It is organized in a hierarchy, corresponding with the list above. An order by the highest ranking available person can only be overruled by a 2/3-majority of the whole Emergency executive Committee (EEC). Until such a majority is reached, the order is valid and has to be followed. Normal constitutional decision-finding processes do not apply during a state of emergency.

VII C 2. The State of Emergency shall end with a majority (51%) vote of the Emergency executive Committee.

VII C 3. The Magistrates can overturn the State of Emergency without the 51% vote if the emergency was reasonably believed to have been called in a non-threatening situation and may cause delay, or harm to TFD and her security, and/or internal structure.

VII C 3 a. The Magistrates’ action can be reversed by majority vote of the EEC inn which the State of Emergency will resume as normal.

VII C 3 b. If the state of emergency hasn’t ended after one month, the Pentarchy (not the Emergency executive Committee (EEC) has to vote to continue it with a majority vote, otherwise it ends.

VII C 4. Violations against the constitution that happened during a state of emergency cannot be prosecuted afterwards. However, it is illegal to change the constitution during the state of emergency. Let it also be stated that during a state of emergency, no rule in the charter may be suspended at any time for any reason, with the exception of Pentarch Elections to not worry about a mid-crisis transition.

XII. Article Eight: The Legal System[]

The Magistrates have the responsibility for conducting all trials within the Foreign Division.

XII A. The Magistrates may hear any case that concerns a matter directly dealt with in the Charter or the laws and treaties of The Foreign Division. Additionally, the Magistrates may hear cases concerning conduct by members of TFD that is not explicitly in the Charter but that affects the security or well-being of the alliance or its members. These issues include but are not limited to:

XII A 1. Harassment

XII A 2. Aid or tech theft

XII A 3. Insubordination or refusing to obey the directions of the TFD government when they are acting within their duties as laid out in the Charter

XII A 4. Chronic inactivity (as defined as an unexplained absent for more than one week or the absence from government duties for more than half of the term of the official for any reason) in the case of government members

XII A 5. Unauthorized declarations of war or spy attacks.

XII B. The Magistrates shall have discretion in determining the specific trial process but any process that is chosen must be conducted fully in public and protect both parties' rights to a fair trial. Any procedure that is chosen by the Magistrates can be overridden by a 3/5 vote of the Pentarchy.

XII C. The defendant shall have the right to appeal the decision to the Pentarchy. The Pentarchy shall make its ruling based on the evidence that has been presented in the trial. If 4/5 of the Pentarchy feel that the Magistrate's ruling was improper, they may overturn it and institute a different ruling.

XII D. The punishments that the Magistrates may levy include but are not limited to monetary fines, community service, temporary expulsions, permanent expulsions, temporary war, and war until zero infrastructure. Expulsions and wars shall be reserved for the most severe offenses like spying, treason, or repeated violations of this charter.

XII E. If a Magistrate was personally involved in a matter, s/he shall be found to have a conflict and removed from the trial. To ensure that three Magistrates are available to hear the case, the Pentarchy may appoint an interim Magistrate for the duration of the trial. The interim Magistrate shall only serve for the purposes of the trial and must also be uninvolved with the case.

IX. Article Nine: Peace and War[]

The Pentarchy is the only body of the Foreign Division that decides on Peace and War. Unprovoked offensive wars (raiding, tech farming etc.) are illegal. Only defensive wars (declaration of wars against nations that have attacked alliance members) are legal, if they are sanctioned by the Pentarchy, the Controller of Security or any Security staff member granted this authority by the Controller of Security. Spy attacks shall also be considered by The Foreign Division to be acts of war.

X. Article Ten: Amendments[]

X A. All discussions and votes on charter amendments must be held in public.

X B. Any member of The Foreign Division may propose an amendment to the charter of the Foreign Division.

X C. Once a charter amendment has been proposed, a discussion period within the alliance will begin. The discussion period must last no less than two days and no more than one week.

X D. After the conclusion of the discussion period, the voting period begins. The voting period shall last an additional seventy-two hours.

X E. Amendments to the charter may be passed one of two ways: popular vote of the Pentarchy or popular vote of the members.

X E 1. Popular vote of the Pentarchy: Amendments to the charter may be ratified by a ⅘ vote of the Pentarchy

X E 2. Popular vote of the members: Amendments to the charter may be also ratified by a majority vote of the membership. For the member vote to be valid, a quantity of members equal to the quantity of the members that voted in the last general election must vote in the amendment vote. If more than 50% of the members that vote are in favor of the amendment and the total member of members that votes equals the amount of members that voted in the last general election, the amendment shall be adopted.

XI. Article Eleven: Mergers, Annexations, and Disbandment[]

XI A. All discussions and votes on concerning mergers, annexations, and disbandment must be held in public.

XI B. Any member of The Foreign Division may propose a merger, annexation, or disbandment but for a proposal to move on to the next stage, at least two Pentarchs must agree to continue discussion of the proposal.

XI C. Once a merger, annexation, or disbandment has been proposed, a discussion period within the alliance will begin. The discussion period must last no less than two days and no more than one week. The discussion period may be ended after less than one week if ⅗ of the Pentarchy votes to close discussion.

XI D. After the discussion of the proposal has been closed, the voting period begins. Mergers, annexations, and disbandment must be also ratified by a majority vote of the membership. For the member vote to be valid, a quantity of members equal to the quantity of the members that voted in the last general election must vote in the amendment vote. If more than 66% of the members that vote are in favor of the amendment and the total member of members that votes equals the amount of members that voted in the last general election, the merger, annexation, or disbandment shall be adopted.


Historical Governments of TFD[]

Pentarchs[]

From 2008 to 2011, The Foreign Division ran on a Senate/Minister/Magistrate system where the popularly elected Senate held the legislative power, the Senate appointed Ministers to hold the executive power, and the popularly elected Magistrates held the judicial power. Although this worked well for a while, eventually, the division of power between the legislative Senate and the executive Ministers caused confusion over whose job it was to do what.

TFD decided to change to a new system where the executive and legislative powers were combined in five elected officials, called Pentarchs. The hope was that by doing this, the executive split between the Senate and the Ministers would be eliminated.

Three of the Penarchs represent the three important areas of the alliance: Diplomacy, Prosperity, Security; and two are at large government officials who oversee of the areas that are outside of or overlap these three such as our directorate system.

President & Speaker[]

The President of The Foreign Division was a Senator and Head of the Ministers. The President managed the elections of the Senate and oversaw all government work. To be eligible for the President position, a nation must have had resided in The Foreign Division for at least 6 months (determined by the joining date on the forums). The term of the President was limited to 3 months.

As of November 2007, the position of President has been replaced by the Speaker. The Speaker is a Senator who is elected by the Senate. He replaces the President completely. That way, TFD has become a parliamentarian democracy.

Senators[]

The Senators are members of the Senate of the alliance. They are elected from general membership of The Foreign Division. To be eligible for a Senate position, a nation must have resided in The Foreign Division for at least 3 months (determined by the joining date on the forums). Senators are in office for 4 months, after which there are elections for the positions. Every two months two senators are re-elected. The two senators up for re-election are the two senators who were not up for election two months previously. Thus every two months two senators are re-elected who then serve for 4 months before being up for election again. There are five seats open for Senators (since November 2007; before, there were only four).

Ministers[]

Ministers are elected by the Senate by from amongst suitable candidates for the position (they must put themselves forward). There are four Ministers for the four Ministries (Immigration, Economic Affairs, Security and Foreign Affairs). A Minister may not be a Senator or vice versa. Ministers are in office for three (3) months, after which there is another election for that position. If a Minister resigns, is expelled or the election result is vetoed, another election is held immediately, for that Minister position only.

Immigration[]

The Minister of Immigration is responsible for the oversight of all activities within the Ministry of Immigration, which includes the growth of The Foreign Division and it's new members. This is promoted through the recruitment of newly created and established unaligned nations. His goal is to promote the recruitment of nations into TFD through constructive means, and he is given special authorization to administer payment, via TFD bank, to aides at his discretion.

Economic Affairs/Alliance Development[]

The Minister of Economic Affairs (later renamed to "Alliance Development") is head of the Tech Deal and Trade Guild Centers. He oversees Tech Deals and Trade Guilds inside of TFD, and organizes said programs with TFD's allies for maximum effect and efficiency. He may appoint aides. In March 2009, the Ministry of Economic Affairs was split into two sections with two Ministers over each section, in order to increase efficiency in the Economic Department. The resulting sections are called the Ministry of Economic Affairs and the Bank of The Foreign Division.

Education[]

The Minister of Education is responsible for the for the oversight of all activities within the Ministry of Education, which includes distribution of game-related information (Cyber Nations Rules and Mechanics) and TFD's rules, laws, and guidelines. The Minister of Education's goal is to educate the membership of TFD to the point where they themselves can guide further new members. He is also in charge of the Academy and is responsible for appointment of the Head of the Academy, however he may assume this role himself. The Minister of Education is given the authorization to administer payment, via TFD bank, to his aides and academy graduates at his discretion.

Academy[]

The Director of the Academy is the head of the Academy and serves under the Minister of Education, with five Education Officers (one of which is filled by the DA) who teach their respective courses. The Academy was reformed to replace the mentor system and is responsible for the training of members on a large scale for futures in their chosen field. The Academy currently offers five different courses that can be taken by members, for which they will receive $3,000,000, a ribbon and a certificate upon successful completion of these courses. The current courses offered by the Academy are the Basic Course, Military Sciences, Economic Sciences, Foreign Relations and Alliance Development. These courses correspond to the various Ministries within TFD.

The Bank[]

The Director of the Bank is head of the Bank & Aid Center. He handles loans and deals with all issues in this area. He also oversees the Nation Development Center. He organizes the routing of aid from the bank to the Nation Development Center to promote maximum overall growth in The Foreign Division. He may appoint aides.

The Minister of Security heads the Defense Group and the Intelligence Group. He coordinates both groups and appoints officers. The internal management of both groups is his responsibility. He can order defense missions to help attacked members. He is also responsible for the proper appliance of the constitution and for the internal security of the alliance. He obeys orders from the Senate only.

Internal Affairs[]

The Minister of Internal Affairs (formerly known as Minister of Immigration) was responsible for the growth of the Foreign Division and for winning new members. He can appoint aides and manages the Foreign Division thread in the “Player Created Alliances”-subforum on the CN-boards. He’s also responsible for helping new members and the aid system. The Minister of Internal Affairs' oversight extends to Community Management, Education, and Communications, which keep the community active, educate and provide guides to the TFD members, and provide a closer interaction between TFD events and TFD's members respectively. On January 25, 2010, the Ministry of Internal Affairs was dissolved and split into the Ministry of Immigration and the Ministry of Education.
